Vinnie Rivera - What I love the most about criminal defense is it gives you the opportunity to take on this massive system that's bigger than you, bigger than your client. Ultimately, there really is two systems, one for the rich and powerful, and one for everybody else. I like that at trial that's the most equal footing we're ever going to have against the law.
If you try and settle the case, that's probably going to end up with you either pleading guilty or entering into a diversion agreement. If you decide to fight the case, you will assert both legal defenses and factual defenses. For example a motion to suppress your statement, claiming that the statement was obtained under duress.
Diversion is designed for first-time offenders, and it helps keep the conviction off your record. The difference between diversion and probation is that probation is after conviction, and diversion is before conviction. In other words, a judge finds you guilty, then he sentences you to probation, as opposed to diversion.
You can break your defenses down into two categories: legal defenses and factual defenses. You're saying that either the police or maybe the prosecutors violated your rights, or are violating your rights in this prosecution. There can also be legal defenses about how you're charged, double jeopardy, and unconstitutional statutes.
I can't tell you how many times I've answered the phone, and the first words out of someone's mouth are: "How much would you charge me to do this?" I would recommend that you talk with several attorneys before you hire someone to defend you. When you choose the attorney that's right for you, you need to do it based on their experience and how well they're going to be able to handle your case and meet your needs.

Mr. Rivera is an amazing attorney. Over the past year he worked closely with my son to help prove his innocence in a matter no child should be put in. Shame on the DA, police, and child services for not taking the time to ACTUALLY investigate the matter fully. Mr. Rivera is an amazing criminal lawyer. He helped me with a case many years ago in which I was wrongly accused. My three co-defendants, one with a renowned criminal attorney, were all in the process of negotiating a plea for a misdemeanor, even though we were innocent.
