Unless Seller receives written notice from Buyer of any objection hereto within fifteen (15) days after the date of Buyer's receipt of this Offer to Sell, and in all events prior to any delivery or other performance by Seller hereunder, any subsequent conduct of Buyer that expresses an intention to purchase the goods described herein shall constitute an unconditional acceptance by Buyer of all the terms and conditions of this Offer to Sell.

1. Acceptance and Complete Agreement This order is Merlin Solar's offer to Supplier and is expressly conditioned upon Supplier's acceptance of these terms and conditions as well as the specifications of the goods, without any amendment. Acceptance of this offer by Supplier should be made by (a) executing and returning the acknowledgment copy, or (b) delivering any of the goods ordered herein.
