Gielowski, Federice & Caligiuri, LLP (The Firm), was initially formed in 1993 by Stephen M. Gielowski. Since that time, the Work Injury Law Firm has grown to six attorneys and continues to concentrate its practice in the field of Workers' Compensation Law. During its existence, the firm has represented thousands of injured workers as well as numerous municipal clients and insurance companies.
The New York State Workers' Compensation Law provides protection to workers who are injured in the course of their employment. Injuries are classified by categories: Accidents and Occupational Diseases. An accidental injury is the most common compensable injury. An acute injury while lifting, bending, climbing or falling are some typical scenarios giving rise to the protections of the law.
If a compensable injury is established, you are entitled to lifetime coverage for medical care. However, such treatment is subject to the Board's Medical Treatment Guidelines. These Workers' Compensation Benefit guidelines dictate the type and frequency of care that you may receive under the statute.
By far, the most frequent Workers' Compensation injuries that we see are those involving back & neck injury. Many types of employment place stress on the vulnerable spinal discs and vertebrae causing serious injuries that require expensive treatment to correct. The spine is subject to injury in many ways including: slipping/falling or lifting and bending repeatedly in the course of your employment.
Injuries to the upper extremities are also common in the work place. Lifting and reaching overhead can give rise to shoulder injury. Repetitive use of a keyboard can give rise to elbow conditions such as epicondylitis and cubital tunnel syndrome. All of these are Workman Compensation injuries.
