Divorce, also called a "dissolution of marriage, " is the legal process by which parties dissolve their marriage in the State of Connecticut. Divorce proceedings usually involve important aspects of people's lives - children, money, property, close human relationships and powerful emotional issues.
Premarital (prenuptial) agreements are when the spouses-to-be agree prior to their marriage on financial and related arrangements upon divorce or the death of a spouse. Premarital agreements are not only advisable for the rich and famous but may make the most sense for those who are entering a second marriage, own a family business, have assets to protect, or are a beneficiary of trusts or inheritances.
In an original divorce proceeding, a final decree ("judgment") is entered either after a trial or an agreement. On occasion, even well-drafted agreements and trial orders can result in the need for modification. Additionally, after a divorce is concluded, the circumstances of one or both of the parties may change so substantially that continuing to adhere to the original orders becomes inequitable/unworkable or no longer required under the law.
When discussing child custody matters, joint custody is a term that creates confusion, and with good reason. It has several meanings as used in Connecticut. The Connecticut statutes define joint custody as awarding legal custody of a minor child to both parents, providing for joint decision-making by the parents and providing that physical custody be shared by the parents in such a way to assure the child of continuing contact with both parents.
