The following California case shows another advantage to Real Estate Mediation to the collection of attorney fee's to the prevailing party. The case clearly shows that to collect the prevailing parties attorney fees, mediation must occur first. Enclosed is the case.

Van Slyke v. Gibson: Under C.A.R.'s mediation and attorney fees clauses, the prevailing party in any action is entitled to reasonable attorney fees and costs, except when that party fails to attempt mediation or refuses to mediate before commencing an action. In this case, a potential buyer wrote an offer using the C.A.R. ResidentialPurchase Agreement.
John and David had purchased a home in Berkeley. They were in a committed relationship, would split all expenses and were approved for a $600,000 mortgage. Their plan was to sell the home within two years. Within months, their relationship went sour and they faced a relationship disaster and a financial crisis.

Very disappointed. Jim did not talk anything concrete to resolve disputes neutrally. He took sides with the seller saying sellers attorney is the only expert person is this real estate matter (why do you need payment then Jim?) and did not point their mistakes or misrepresentations of the property. waste of money.

Very very disappointed. If I knew now what i know now I would of never used Jim Mediation services.Every time you call him he is too busy to talk to you and never returned messages . He would say he would call you back but never does. Jim was doing an eviction for me ,, he calls the tenants in and hired the tenant to work in his office . That was not right . I'm very disappointed with Jim and you should be aware of his unprofessional conduct

Jim came to my door via my landlord because of COVID-19 and it was the first time i had ever not been able to pay rent. He immediately calmed my worries and helped me fill out the proper forms that were actually brand new. Even though the documents were days old, he was still very knowledgeable and helped me navigate the process with ease. I'll be using Jim for everything from Notary services to Mediation to avoid arbitration or litigation, and i would absolutely recommend him to anyone looking for any Legal document assistance, real estate, or mediation needs.

We had an escrow cancel and the parties could not agree on what to do with the funds that we were holding. We wound up sitting down with the parties and Jim. Jim was able to come up with an agreement that was acceptable to all very quickly, saving time and money. Good Job Jim!

I have worked alongside Jim for about 40 years in the Real Estate field. He has always been very attentive, thorough and hard working. There are no hours he won't work or jobs he won't do in the interests of his client. He uses that same dogged determination in his new role as Mediator.
