A Felony is an offense for which a sentence to a term of imprisonment in excess of one year may be imposed (New York State Penal Law, Article 10). A Felony is a crime. There are five (5) categories and two (2) sub categories of Felonies (A-1, A-II, B, C, D, and E) ranging from the most to least serious in terms of severity of offense and the degree of potential punishment incurred.
The first offense is Driving While Ability Impaired (DWAI). This offense is committed where the driver consumed alcohol to the extent that he "has actually impaired, to any extent, the physical and mental abilities which he is expected to possess in order to operate a vehicle as a reasonable and prudent driver."
In some cases, when you are arrested for certain misdemeanor offenses, you may receive a Desk Appearance Ticket (DAT), a document advising you when to make a court appearance at a future date. You may also be eligible for a Desk Appearance Ticket if the highest offense is a class "E" felony, although the DAT process in any felony case is not the norm.

Very upright and professional in this Law business, he was able to contest 3 tickets for me at Freeport and the tickets were dismissed, one for improper plate, second for no insurance but the car have insurance while the cop was not ready to listen to me, the third one for no inspection. I received two tickets about 5 months ago and contacted Michael based on some glowing reviews I found online. Due to the pandemic, the case was delayed greatly, but Michael was very prompt, responsive and helpful no matter when I contacted him looking for updates. I found Mike while doing a Google search. And, I chose him to represent me based on the reviews that were already written about him. Everything that was written was accurate. What was most impressive though was that I connected with him when things closed down due to the pandemic and he stayed on top of things even that court dates were repeatedly delayed.
