When a loved one passes away, the emotional process of sorting out their estate begins. Probate administration occurs when someone dies with a will that needs to be submitted to probate court for administration. This necessary process settles the debts of the estate, inventories and appraises property, and transfers title to the intended beneficiaries.
When someone passes away, a Florida probate will likely follow. Essentially, probate is the court-supervised process of authenticating someone's last will and testament. Someone who has an interest in a Florida estate can start the probate process by filing the necessary "petition for administration" with the proper court clerk, which would be in the Florida county where the person died or where the assets are located.
A Florida power of attorney is a legal document that allows you to delegate authority to someone else. The person granting the power is the principal and gives someone else the right to act on his or her behalf as an agent. What you grant attorney for will vary depending on the specific language including in the power of attorney document.

The Probate Rules are extremely important when it comes to Florida law regarding estates, wills, and even guardianships.
