Criminal Possession of a Weapon in the 4th Degree. Defense moved to suppress knife and refusal evidence prior to trial. After evidentiary hearing, knife and refusal evidence suppressed, which led to dismissal of Weapon charge and reduction of DWI to DWAI, and then to Not Guilty verdict by Judge after trial.
