If divorce is like a trip through a jungle, the mediator is your guide who's traveled through the same territory hundreds or thousands of times. Each trip is similar to the others, but different because the jungle is never the same. Once the couple commits to taking the trip, the guide's job is to get them to the other side by avoiding the specific dangers about which they're particularly concerned.
I have developed a professional practice by use of the ideas of and tools created by an MIT professor called Donald A. Schn and described in his books: The Reflective Practitioner [1982] and The Education of the Reflective Practitioner [1987], and made more useful by my friend Steward Shapiro in Case Studies in Reflective Inquiry [2204].
When providing consultation services, the client doesn't need to agree with anything I say and he can still have a profitable consultation. Once I've presented the information he wants and the information I think is important, he keeps what he things is useful and we discard the rest. We use the data he selects for the decision making process.
Even though it is at the low end of the rates charged in Santa Barbara by Certified Family Law Specialists, $360 an hour is, at first glance, shocking. At least 90% of the charges for conventional representation in a divorce are incurred outside the presence of the client. Pause to consider the significance of the difference; it's huge.
