Most people have a pretty good idea of 'who' is going to receive their property - although today's families sometimes cause unwanted heirs to be able to enter the estate. Children's ex-spouses, grandchildren with no ties to the property or stepchildren or adopted children can easily become heirs without planning.
The first thing I have to tell you about wills and trusts is that we cannot write wills and trusts for you. You need to go to an attorney to have them drafted - or act as attorney for yourself and write them yourselves. I am not a licensed attorney and therefore I cannot draft them or give you legal advice on how a will or trust should be drafted.
Our main office is in Bismarck, ND. Those in the surrounding area, in such places as Steele or Ashley, can come to our office. We also travel to various locations to meet with clients throughout the state. For those living in the upper western part of North Dakota, such as Harvey and Tioga, we meet with clients in Minot at the Staybridge Suites, 3009 South Broadway.

Dividing assets between two classes of heirs (children) can be very difficult to do, especially if one of the children has been materially participating in the farm. A couple with no farm assets has a far easier time settling their estate than do farm owners.
Hi Michael: I have a question for you. We have quite a bit of land with little or no basis in the property. Our tax person told us if we pass this to our children they will receive a stepped-up basis in the land - if they farm it for three years. Would an irrevocable trust be the way to go? How does the new estate tax proposal change how we should be planning?
