The "Right of First Refusal" is a provision frequently written into custody orders and parenting plans. But what the heck is it? Basically, it is a provision that states before a parent can use a third party babysitter or daycare, they must give the other parent the right to watch the children first.

Going to court to resolve legal issues, especially in divorce and child custody cases, can take months or even years to get resolved. In most cases even getting a hearing in front of a judge can take several weeks to several months. However, if the child is in imminent danger from a parent, the other parent can file an emergency motion with the court.
