Services
Now that you have decided to buy a home, what happens between now and the time you can become the legal owner? First, your loan application will have to be approved. In doing this, the lender will include a credit check on you and require an appraisal and survey of the property. Legal papers will be prepared for you (and the seller) to sign.
A title is the right to ownership and possession of home or property. It is possible that someone other than the owner has a legal right to the property. If that right can be established, this person can claim the property outright or make demands on the owner as to its use. Any number of problems that remain undisclosed after even the most careful search of public records can make a title defective.
Title insurance protects you and your lender if someone challenges your title to your property because of title defects that were unknown when you bought the policy. Most lending institutions will not loan money to purchase a house or other property unless you buy a Loan Policy of Title Insurance. This policy protects the lender's investment by paying the mortgage (loan amount) if a title defect voids your title.
A Commitment for title insurance is an Underwriter's offer to issue a title policy to the proposed insured upon payment of the premium and other charges due, subject to the exceptions and requirements in Schedule "B" and Schedule "C" and subject to the Policy's Conditions and Stipulations.

In order for the Commitment to be valid, the proposed insured's name and the policy amount must be shown in Schedule "A", and an authorized representative must countersign the jacket.The Commitment expires ninety (90) days from the effective date of the Commitment. The Company's liability and obligations end when the Commitment expires unless the policy is issued.
A survey is a geographical description of the boundary of a particular piece of property. It gives the dimensions and acreage of the property being bought or sold and provides a tangible representation of the property. Surveys are done in order to produce a reliable, current description of the property in question.
