Cusack Law Office LLC is here to help with difficult and personal matters. When people come to us upon the death of a loved one, we are equipped to provide the assistance necessary to handle the estate and other issues that arise as a result of the loss. When people are ready to work on their estate plan, we can inform about the options available and then create the documents that will make the appropriate plan work.
We assist clients in creating the proper estate plan for their particular needs. We can draft Wills, Trusts, Powers of Attorney, Living Wills, Deeds and other documents to carry those plans into action. We open a dialogue that allows us to ask the right questions. There are many what ifs that need to be a part of the plan.
If there is no will, the courts will appoint an administrator for the estate and distribute property according to Ohio law. In many cases, this is not what the deceased would have considered ideal. Having a will makes obvious sense. We understand that it's not a pleasent thing to think about, but the alternative is usually worse.
A trust allows an individual to assign someone to manage his or her property. Property is anything including land, physical assets, stocks and bonds, cash etc. A trust can come into play when a persons health begins to fail or becomes in some way incapable of handling his own affairs. The trust allows the owner to transfer property management to a custodian - i.e. the trustee.
While many clients come to the office stating their intention to "avoid probate, " a lot of those same people are not really sure what probate is. The simple answer is that probate in Ohio is a court supervised process to administer certain property owned by the deceased. We call the property that requires probate administration "probate property."
