We also represent clients in acquiring assets and businesses out of bankruptcy proceedings.
We represent distressed business in negotiating with lenders and other creditors in an effort to avoid bankruptcy. We are often able to use our Chapter 11 experience as a means through which to negotiate modifications and settlements with creditors. Compromises with creditors include discounted payoffs, forbearances, modifications, and structured payouts.
We represent businesses in Chapter 11 reorganizations. Sometimes an out of court workout is neither possible nor otherwise strategically beneficial. Therefore, we represent businesses in all facets of Chapter 11 reorganizations. We have also used Chapter 11 as a means of effectuating and otherwise implementing transactions, including sales of assets and businesses.
We represent parties sued in bankruptcy matters, including, without limitation, providing defense of preference and fraudulent transfer matters. We have also been engaged to serve as special litigation counsel in complex bankruptcy litigation matters in both Chapter 7 and Chapter 11 cases. We also represent parties in state and federal courts in commercial litigation matters.
