The law office of Timothy P. Smith is limited to bankruptcy and insolvency issues, with a focus on consumer cases (Chapter 7 and Chapter 13). Prior to opening my office in September of 1987, I had seven years of experience serving as Clerk of the Bankruptcy Court, for the District of New Hampshire.

There are two types of bankruptcy for which consumer debtors may file; these proceedings are outlined in Chapter 7 and Chapter 13 of the Bankruptcy Code. The basic premise of Chapter 7 is that you surrender your non-exempt assets in return for a discharge of your debts. Most consumer debtors do not lose any assets as a result of filing Chapter 7 because of the exemptions provided by the code itself or the State of New Hampshire.
A decision to file for bankruptcy should be made only after determining that bankruptcy is the best way to deal with your financial problems. This booklet cannot explain every aspect of the bankruptcy process. If you still have questions after reading it, you should speak with an attorney familiar with bankruptcy.
