Isabel Barbarin is an experienced immigration lawyer providing nationwide services, focused on U.S. Immigration and Nationality Law. Ms. Barbarin guides families through the immigration process and assists with both consular processing and applications for family members already in the United States.
U.S. Citizen parents are eligible to petition for their children (must be under 21 years old) to be considered an Immediate relative. If the child is over 21 years then not considered an immediate relative (either 1st preference category or 3rd preference category depends on whether married); will need to wait for a visa number to become current in order to adjust status.
If the green card has expired, this does not mean that the Permanent Residence status is expired, it simply means that the document evidencing the status has expired. However, it is your responsibility to renew your green card. You should for immigration purposes have a valid unexpired green card If you are travelling outside the U.S. Let our office assist you in renewing your green card.
Must be a Lawful Permanent Resident/LPR/Green Card holder for five years; different rules apply whether spouse of a U.S. citizen or VAWA (Violence against Women Act) - contact our office for an explanation. Must be continuously present in the U.S. Over one year outside the U.S. automatically abandon the green card if no reentry permit filed.
An L-1 visa allows foreign workers (Managers/Executives/Specialized knowledge skill), to transfer from the foreign Co. and work in the U.S. company temporarily. Beneficiary must have been employed abroad continuously for one year by the parent, branch, affiliate, or subsidiary of the U.S. petitioning company, within three (3) years preceding application for admission under the L visa.
