I have been a Hawaii consumer bankruptcy lawyer since 1995. Before representing debtors in bankruptcy, I was exposed to bankruptcy by representing creditors as a Honolulu bankruptcy attorney. I quickly saw that the way to really make a difference (which was why I went to law school in the first place) was to assist the honest but unfortunate debtor to gain a fresh start.
I am Honolulu bankruptcy attorney Ed Magauran. I have been practicing for more than 20 years, including some years as a bankruptcy lawyer for creditors. Today, I focus my entire practice on helping people like you get out from under the crushing burden of debt. Not all bankruptcy lawyers are the same.
If your house is worth less than you owe on your first mortgage and you otherwise qualify for a chapter 13 bankruptcy, the second mortgage, if you have one, can be "stripped." The bankruptcy court recognizes that if the house were to be foreclosed on, it would sell for less than is owed on the first mortgage and the second mortgage would get nothing.
Once you file for chapter 7, your bankruptcy estate is created and the Court sets the date of the meeting of creditors or 341a hearing. The hearing is normally 30-45 days after the date of filing. All of your creditors are notified of the meeting and that you filed for bankruptcy. They or their counsel can ask you questions about the nature and validity of the debts at the meeting of creditors.

Bankruptcy is uncomfortable and embarrassing to say the least. Ed had an awesome sense of humor, he made me feel comfortable, and set my mind at ease. He always answered my calls and made sure to answer all of my questions. I had my zoom meeting with counsel of creditors, and I saw some of the issues other debtors had because of insufficiencies on their attorneys behalves. I am not sure the positive reviews are accurate or even made by real people. This lawyer does not have the best interest of his client in mind and actually is making our current situation even worse and more stressful that before we filed!!! It doesn't feel like he is supposed to be representing us as paying clients but it rather feels like he is leaning more towards getting more money out of us knowing that we are already in a desperate situation. Filing for bankruptcy can be a frightening and difficult decision. Finding the right person to represent you will make the process that much easier. Edward was very clear about what needed to be prepared and what would be required to have a seamless filing, having me be over prepared and completely secure about the resolution. After calling several other bankruptcy offices, Mr. Magauran was the only lawyer that seemed to have my best interests in mind.
