If you die without a Will, the State of Nebraska (through the state "intestate" laws) will tell your family what will happen to your assets. If you die without a Will and have minor children, your family will be forced to file a lawsuit to ask the court to appoint a guardian for them.

The Personal Representative must act in a fiduciary capacity, so avoid any transaction that will result in a conflict of interest between you and the estate. Remember that many activities such as the sale of real estate and the distribution of assets will require court approval. You will need to maintain and secure all assets.
