Child support is essentially set by statute and absent unusual circumstances, child support will be awarded in accordance with the South Carolina Child Support Guidelines. Child support is calculated based upon the combined incomes of both parties which establishes the base combined child support obligation.
Equitable distribution is the way the Court divides marital property and debt. It is based on principles of equity, which means fairness. It differs from community property states in that there is not an automatic 50/50 division of marital property and debt.
