Child support is essentially set by statute and absent unusual circumstances, child support will be awarded in accordance with the South Carolina Child Support Guidelines. Child support is calculated based upon the combined incomes of both parties which establishes the base combined child support obligation.
Equitable distribution is the way the Court divides marital property and debt. It is based on principles of equity, which means fairness. It differs from community property states in that there is not an automatic 50/50 division of marital property and debt. While it is not unusual for the court to divide marital property and debt 50/50, it is by no means automatic.
Mediation is an informal process in which the parties attempt through negotiation to settle the issues of their case. Typically, the parties are in separate rooms with their attorneys and the mediator travels back and forth between the rooms in order to convey settlement offers between the parties.
A prenuptial agreement is a contract entered into between the parties to an upcoming marriage which must be entered into prior to the marriage ceremony. The purpose of a prenuptial agreement is to settle before marriage, the outcome of issues which arise as the result of the marital relationship.

Prenuptial Agreements often address the financial responsibilities of each party during the marriage and additionally provide for what will happen in the event of death or divorce.South Carolina requires that in order for a prenuptial agreement entered into in South Carolina to be valid, that the parties each make full financial disclosure to the other and that they have the advice of separate attorneys.
A separation agreement is a contract between the parties to the litigation which is entered into prior to the final dissolution of the parties' marriage. A separation agreement settles all issues arising out of the breakup of the parties' marriage.

Common issues which are resolved by a separation agreement include, but are not limited to the disposition of personal property, real property, pension rights, debts, alimony, child custody, child support, medical insurance, taxes and any other issues between the parties.A separation agreement can be entered into whenever the parties reach an agreement.
