Michelle Labayen has been practicing Consumer and Bankruptcy law for more than 17 years. She is a member of the National Association of Consumer Bankruptcy Attorneys (NACBA), and the National Association of Consumer Advocates (NACA). In addition, she is a Max Gardner Bootcamp graduate. Experience working for National Banks has enabled Michelle to have a thorough understanding of the legal practices of credit card companies and foreclosure firms.
Chapter 13 of the Bankruptcy Code provides for an adjustment of debt to be repaid by an individual with regular income. It allows the debtor to keep property and repay debts over a three (3) to five (5) year period. Also known as the wage earners plan, it enables individuals with regular income to develop a plan to repay all or a portion of their debts.
Student loans account for the second highest consumer debt category in the United States. On average, federal student loan debt for a college graduate is more than $36,000 per borrower. For private loans, the average is over $54,000. Only in limited circumstances can student debt be discharged through Chapter 7 or Chapter 13 bankruptcy.

I too am one of the millions who (wrongly) believed I would be stuck with my student loan debt for the rest of my life. I also (wrongly) believed that bankruptcy was NOT an option for anyone with student loan unless you were the most indigent or totally disabled. Deferrment, forebearance, IBR -- I did them all and never made a dent in my illegally high 7.87% interest rate.
