Many buyers and sellers of residential real estate are reluctant to hire an attorney, choosing instead to rely on form contracts and inexperienced title companies, due primarily to the misconception that a real estate attorney costs too much money or will complicate the process. Believing these misconceptions can cost you precious time and money.
The first step in a foreclosure suit is the filing of a lis pendens. A lis pendens is recorded in the public records putting the public on notice that a lawsuit has been filed against you. After your lender files the lis pendens and the Complaint, a process server will serve you with the lis pendens, the Complaint and the Summons.
A short sale occurs when a lending institution or bank accepts less than what is owed on the mortgage as a "short" payoff. Due to the decline in real estate values, more and more homeowners find themselves owing more than what their properties are worth. Many are in situations where they can no longer afford to pay the mortgage or are being forced to relocate due to work-related circumstances.
The transfer of Commercial Real Estate is an extensive and involved process that should never be taken lightly. Much like the time and effort spent in finding that great commercial property, the closing process requires the same degree of meticulous care and thoughtfulness to be completed correctly and efficiently.
By selling your home without the help of a real estate agent you may be able to save the 6% commission typically paid to agents on a home sale. On a $250,000 home, that represents a potential savings of over $12,000. Or you can use those savings to offer your home for sale at a lower price, which may help you attract a larger pool of interested buyers and sell your home quicker.

I would like to highly recommend Heekin Law for all of your real estate law needs. I have had experience with David Heekin who always answers my emails and took a great deal of time to sit down and explain to me different options for short sale of properties and filing for bankruptcy after my husband died and I was struggling to try and understand my options.
