Guardianship is a legal relationship established by the court that assigns an individual or program to a person who has developmental disabilities, dementia, brain injury, chronic mental illness, or any other issue that makes them incapable of caring for themselves.

To establish guardianship in Wisconsin, the court must find that an individual is substantially unable to provide for his or her physical, emotional, medical, or residential needs and unable to make "informed decisions."If it is determined a person is at risk, the guardian is given the right to make decisions on behalf of the incapacitated individual.
Foster parents are a critical part of the child welfare system, yet they are underappreciated. Foster parents take abused and traumatized children and give them a family life while their parents are in a bad situation. In Wisconsin, foster parents have the right to object when the agency changes the foster child's placement.
When someone marries a person who is already a parent and a relationship is established with the child that person often considers adopting the child. This is known as step-parent adoption. Termination of parental rights is always easier if the child's natural parent is absent or agrees, but stepparent adoptions can occur even if both biological parents do not consent.
