Although permission from the Court is needed to buy or sell property, it's generally not difficult if the purchase or sale is reasonable, even if it means needing to reduce the Chapter 13 plan payment. Many of our Chapter 13 clients have had to buy vehicles or sell houses while in Chapter 13. To accomplish this we need information about the property to be sold or purchased, such as price, what type of property e.g.
Owing taxes to the IRS or Iowa Department of Revenue can feel like the worst type of debt you could have, but in reality there are several options for dealing with tax debt. For example, discharging taxes in bankruptcy is not as difficult as people think. You just have to follow some specific rules.
Thousands of people file bankruptcy each day because hard times prevent them from paying their bills. Job and medical problems are the most common reasons people file bankruptcy. A study by Harvard Law School showed that two out of three people in bankruptcy have lost their job and half have experienced a serious health problem.
Consumers in Iowa can sue someone who knows or should know their conduct is an unfair practice, deception, false promise or false pretense. The conduct must be in connection with the advertisement, sale or lease of consumer merchandise, but the definition of merchandise is broadly defined to cover services, goods and many other items.
Unfortunately, most people do nothing to defend debt collection lawsuits. Maybe that's because they don't think there's anything that can be done or maybe they don't want to spend money on a lawyer. But there are sometimes defenses to these lawsuits and it might be cheaper to pay an attorney to defend the lawsuit than to let a large debt become a judgment.
