Brady Hair and Derk Van Raalte both served as Assistant United States Attorneys in the Charleston office of the District of South Carolina. While in the U.S. Attorney's Office, Brady Hair prosecuted one of the highest profile bank fraud cases in South Carolina's history. His investigation led to the convictions of the bank president and several members of the board of directors.
In South Carolina, our attorneys have dealt with False Claims Act (FCA)/Qui Tam cases for the past 20 years. These case often start as "Whistleblower" type allegations that are subsequently pressed forward in the name of the United States Government. We help hospitals, doctors, ambulance services, hospice organizations, government contractors and more avoid and deal with False Claims Act cases in Federal Court.
Mediation is no longer just a good idea, it's mandated in almost every State and Federal case filed in South Carolina. Mediation offers both sides the opportunity to fairly resolve their claims without the expense and difficulty of a trial. It is also much faster. The civil justice system is overloaded and court cases can take years to resolve.
The South Carolina Attorney General's Office has a very active criminal enforcement division. The Attorney General investigates a variety of fraud cases directly and through the statewide grand jury. Such investigations include matters related to Medicaid, securities, fraud, and DHEC environmental issues, among others.
Corporations often have a need for outside counsel to handle matters that their in-house lawyers cannot. This sometimes occurs because in-house counsel doesn't practice in the area that is needed. Hair and Van Raalte have assisted many corporate clients with criminal investigations that in-house counsel was not equipped to handle.
