A will helps simplify the legal process. If your loved one created a will, the first step is typically to file an application with the court to admit the document for probate. Most wills, especially those drafted by attorneys, designate an executor, an individual in charge of ensuring all provisions are met and followed as closely as possible.
Texas uses what is known as "intestacy law" to determine who gets your property if you die without a Will. Basically, your separate property and community property pass to your relatives in different percentages based on your family makeup. If all of your property is community property, your spouse gets everything.
What the heck is a "trust" and why should I care? Good questions. The answers may save you money, time, and headaches. Plus, setting up these documents may greatly improve life for you, your family, and those who will inherit from you. To help you understand, we've provided a quick and easy overview below for a variety of trusts.

I highly recommend this group of attorneys! Travis Weaver has hosted several Medicaid Info seminars at my facility, Decatur Medical Lodge. Each one was standing room only and everyone walked away with a deeper understanding of Medicaid. They are quick to respond and stand ready to assist whenever needed! I've worked with Travis Weaver, Rick Weaver, and Chris Weaver on projects to help clients easily understand their options for nursing home qualification, setting up wills and probating wills, and explaining business legal options. All have been concerned that clients receive the best legal advice to make informed decisions for their personal situation. I have been impressed with the kindness and genuine compassion the attorneys and staff express about the families they help with legal matters.
