Bankruptcy is the legal method by which a debt-ridden person may eliminate debt and obtain a new financial beginning. The filing of bankruptcy will immediately stop the efforts of creditors from seeking to collect upon debts. In most cases, bankruptcy will completely eliminate the debt one owes to creditors.
Mr. Sessions was born in Wyoming and moved to Utah over 25 years ago. He graduated from Orem High School and attended Utah State University where he majored in business with a specialization in finance and a minor in economics. After graduating from Utah State in three years he attended law school at the University of Oregon, graduating in 1991 with a J. D. degree.
Lawyers are trained professionals who can explain the laws to you; help you evaluate your options; negotiate or mediate conflicts with other people; prepare letters, court forms or other legal documents for you; and represent you in court. Some cases are charged on a flat fee basis. If you have such a case, our attorneys can generally tell you up front how much your case will cost.
The Utah Exemptions Act sets forth the limitations that one can claim as exempt in a bankruptcy case. In determining whether property is exempt, you must keep a few things in mind. The value of property is not the amount you paid for it, but what it is worth now. Especially for furniture and cars, this may be a lot less than what you paid or what it would cost to buy a replacement.
