Chapter 7 bankruptcy is the most common form of bankruptcy and is frequently referred to as "liquidation." Under liquidation, non-exempt property of the bankruptcy estate can be sold by a bankruptcy trustee to partially or fully satisfy creditors. Following the distribution of assets to creditors, most debts are discharged, or wiped clean.
Many Kentucky & OH residents want to avail themselves of the benefits of bankruptcy, but they fear the loss of personal property and assets, including their home, car, wages, pensions and retirement accounts. In some instances, this fear is well founded. While bankruptcy is a powerful tool to dispatch debt, selecting the wrong form can force you to give up property.
Richard Sadoff and his associates represent individuals and estates in Ohio and Kentucky through the probate process. Probate is the legal process by which a deceased person's estate is properly distributed to heirs or designated beneficiaries and any debt owed to creditors is paid off. In all likelihood an estate with assets will have to be distributed through probate, whether or not the deceased had a will.
