Esther Lewis was driving on a country road to her home with her daughter and son as passengers. Her vehicle was struck by a KCS "helper service" locomotive at an unmarked crossing near Goodman, Missouri. Esther and her daughter were killed, while Esther's son, Jared, was injured.

Esther's husband, Terry, brought claims for wrongful death and personal injury against the railroad, claiming that the crossing should have had warnings, lights, and a crossing guard.There was also an issue of engineer fatigue. Jeremy Abercrombie was commuting to work in Rogers, Arkansas on U.S. Highway 71 when a tractor trailer pulled into his path while making a left turn. Jeremy was killed instantly. Jeremy's parents brought a wrongful death action against the trucking company. Jeremy was a 26 years old, single, without children.
