Chapter 7 bankruptcy is a federal court proceeding where honest debtors are forgiven many of their outstanding obligations. It is called a liquidation proceeding because a trustee is appointed to ascertain which of the debtors assets are not protected and are subject to being sold by the Trustee's Office for the repayment of creditors.
Chapter 7 bankruptcy, also referred to as liquidation bankruptcy, is a powerful legal tool that allows people to wipe out many forms of debt. The most common type of bankruptcy, Chapter 7 can clear most unsecured debts which refer to debts without collateral. Though this can provide significant debt relief, it also has long-lasting effects on credit scores.
If a creditor obtains a judgement against you, or if you file for bankruptcy, certain assets that you own cannot be taken from you to pay your debts. These assets are called "exempt assets" or merely "exemptions". Simply stated, exemptions are the assets that you get to keep from your creditors unless you specifically pledged the asset as collateral on a loan.
To discharge a debt means that a federal court declares that a debt is no longer enforceable. It cannot be legally collected by demand once it is deemed discharged by the court. Bankruptcy laws are written to allow honest debtors to get a fresh start. However, there are some limitations to this policy.
