Chapter 7 is the legal way to declare yourself unable to pay your debts. To file a Chapter 7, under the new law, your income and expenses must meet certain guidelines, demonstrating that you unable to pay your debts. When the Chapter 7 is completed, you will receive a Court Order discharging your legal obligation to pay your creditors.
Chapter 13 is a Court proceeding that is filed with the US Bankruptcy Court, allowing you to arrange a payment plan to pay all of your bills through the Chapter 13 Trustee. Chapter 13 provides debt relief, eliminates bill problems, and stops harassment by creditors.

Many people are eligible to file a Chapter 7, even if they own a house, depending on the market value of the house and the size of the mortgage. If your house has too much value, it may be necessary to file a Chapter 13.
