If you have a Trust, the Trust estate still needs to be administered, typically out of court, and although it is simpler procedurally to administer a Trust, there are still many items that will need to be accomplished. These issues can be confusing or seemingly difficult, especially when a friend or family member can no longer handle their own affairs or are deceased.
Many clients wish to avoid probate because they may have heard advertisements or seminars that have presented information about how challenging probate can be. The California Probate Code is the body of law that governs the protection of those who cannot take care of themselves and how their assets are passed upon their death.
The legal term used for when a person passed away without a Will is "intestate." If the estate is worth more than $150,000 then the County Superior Court will need to oversee the administration of the estate. The person appointed to handle the estate is called the "Administrator."
If there is a claimed unknown heir, unknown spouse, creditor, if you disagree with how the estate is being handled, you can file an objection, and you are entitled to a trial on the issue.

If you disagree with provisions of a Will, you must have "standing" to file a petition with the Court to object or to oppose an objection. Interested persons can include heirs at law, a beneficiary under a prior Will, a beneficiary under a destroyed Will, an Executor, and a personal representative of the estate.

We used the law services of Mr. Greensides several times. He worked with us on creating a will, a family trust and transferring property to the trust. Working with him has been a frictionless experience throughout. He did not waste our time and was efficient in getting the information he needed. He provided the required services rather quickly. Most of the interaction was done remotely so we could keep our busy schedules with minimal interruption. Dealing with legal issues is never fun, but Mr. Greenside made it painless. Ian held us with wills and trust for the family. I had ARAG (legal service) from my work and I found Mr. Greensides through that service. Working with him was great, one Simple phone conversation explained the process. He sent the documents to be filled by email and I replied back. In 2 weeks everything was all ready for us to go sign. I had a previous family law case that was being grossly overcharged for....not only did Ian give me solid, helpful advice regarding that case, he also saved our family nearly $50,000 in attorney fees. If you want to hire a mean, unprincipled, aggressive, unskilled and costly attorney, Ian is NOT your man. He has an extremely strong moral compass, and a non-challenging but also firm presence in the courtroom, which goes a long way with judges. I've been around attorney's my whole life. My mom worked for the DA in New York and my wife is a court reporter.
