Meet Dona Ana County District Attorney Gerald Byers who took office in January of 2021 on a pledge to reform the office, restore public confidence, and make the office more accountable to the community. Honoring crime victims and respecting the rights of criminal defendants are not mutually exclusive concepts.
The District Attorney's job is an obligation to do so. Is a criminal justice system that effectively balances the need for public security within our communities and the rights of the individual accused of crimes. For minor criminal offenses, my administration will consider case resolution by use of diversionary programs where feasible. However, we will also pursue significant criminal penalties for exceptionally heinous offenses where such a disposition is either warranted or mandatory.
Many crime victims find the criminal justice system a frightening and intimidating process. If you are impacted by a crime or a victim of crime, the Victim Assistance Division is here to help provide information, assistance, and support during this difficult time. Our advocates are available to help you understand how the system works because many victims find themselves alone, helpless, and without resources.
Victims' rights are protected by law enforcement agencies, prosecutors and judges as vigorously as are the rights of criminal defendants; and. The provisions of Article 2. Section 24 of the constitution of New Mexico are implemented in statute. Make a statement to the court at sentencing and at any post sentencing hearings for the accused.

Lisa Cano was murdered by her son, Joshua Hunt on July 18th, 2014. He has been charged with 1st degree murder and tampering with evidence. Joshua killed his mother by striking her 16 times with a sword while she slept. This man is undoubtedly guilty and yet the Las Cruces District Attourney has yet to convict and sentence him. I under stand there is a legal 'process'. What I don't understand is why it has taken so long for there to be justice for Lisa. I was originally in contact with the victim advocate.
