Our firm focuses a significant portion of our practice in the areas of Florida Estate Planning and Probate Law. We provide our Clients with custom estate planning solutions that fit their family and wealth preservation goals. If you fail to create an estate plan, the State of Florida will decide how your assets are going to be distributed through the Probate process.
In addition to Florida Probate Administration, our firm is actively involved in the litigation of Probate disputes. These types of actions can include Will Contests, Objections to Probate Administration, Trust Contests, and Actions to Remove the Appointed Personal Representative, Life Insurance disputes and litigation involving Creditor Claims.
In contrast to Summary Administration, Florida's Formal Administration probate procedure is required for estates larger than $75,000.00 and when the decedent has been passed for less than two years.
Although not always required, Formal Administration is a good idea to invoke when you have more complicated estates, challenges to creditor claims and can be easier if your estate requires that you work closely with third parties (examples include foreclosure, insurance related issues etc.).

Florida law gives interested parties the ability to challenge the validity of the last will and testament being offered for Probate Administration. If you think that the last will and testament being offered to probate was procured by fraud, duress, trickery or any unethical means you have rights. These types of challenges are commonly referred to as will contests.

The passing of any loved one is a very emotional and trying time. Dealing with the 'system's' probate requirement merely amplified the ordeal. I reached out to several attorneys in my area.
