Several sections of the California Penal Code address Domestic Violence. Factors including severity of violence and harm to victim will determine what the defendant will be charged with. Domestic Battery means touching someone (who is either your spouse, ex-spouse, fiance, ex-fiance, cohabitant, ex-cohabitant, parent of your child, partner in a dating relationship or former partner) in a harmful or offensive way.
One can be charged with ADW in the State of California by assaulting (Link to Assault) someone with either a deadly weapon or with means of force likely to produce great bodily injury. A deadly weapon can be anything from a gun to a shoe to a cinder block - almost anything in some way, shape or form can be used as a deadly weapon.

I was told that I was going to be prepped and prepared for our hearing a week after I paid the lawyer retainer. They had said that they would schedule the hearing with the hearing officer and that they'd reach out to me. I did not hear back from them and I had been waiting for the call back. It ended up being 2 days before the trial and I had reached out to see if our court date had changed.
I was given a call back later in the afternoon to prepare for our hearing that was the next day.

The local DA was coming at me pretty hard for something minor from nearly 3 years ago. Definitely not something worth getting arrested over but, they thought differently. When I realized I had a warrant this law office took care of it that same day. When it was all said and done I paid small fine and got minimal ECP days. Less then 5 days! Now I'm all clear thanks to these amazing lawyers.

Used this law firm in 2019 and was assigned Malalai Farooqi. I read the reviews and did my research and even though it cost me a lot of money I wanted to be sure I was hiring a quality attorney to help with a case of "we can't find anyone else so we'll just charge you with the crime". Ms Farooqi hardly communicated with me, seemed like it was a hassle getting her to even show up, barely communicated with my boyfriend regarding his case, never showed him the supposed "video footage" of the event and didn't even try to fight for justice and left him with a plea

I only called to ask a question Mr. Scafiddi had no hesitation on taking a few moments out of his busy schedule to answer my question and to also give some suggestions as well. Eve and Mike are the best at what they do. They are very professional and responsive attorneys.
I was falsely accused of several things by extremely cunning neighbors. They did not tell me they had any issues with me but went to court and got a TRO against me. Now I realize what the elders say, No matter how much education one has, it really matters how you are raised (those neighbors are both MDs at Kaiser in Southern CA).

I went to Michael after I got a DUI. When I first met Michael he was very personable. Michael went over all aspects of my case and didn't sugar coat what I could be facing. That's what I also found to be great! Don't tell me what I want to hear, just be straight up with me and that what he does.

Michael Scafiddi is a horrible attorney and person. He took advantage of me at the most vulnerable point in my life. Prior to hiring him, he was polite, professional, and seemed like he'd do a good job. WRONG! Once Scaffidi got my money his attitude changed. He never kept me up to date on the status of my case and seemed annoyed that I would even be calling him. His staff was discourteous and unprofessional and would only put him on the phone after I repeatedly called. Watch out for this law firm because they are a bunch of cheats.
