Family Law is the body of law that in California governs marriage, marital dissolution (also known as divorce), dissolution of domestic partnerships, paternity, child custody, child support, spousal support (sometimes known as alimony), domestic violence, premarital agreements (prenuptial agreements), post-marital agreements ("antenuptial", agreements made during the marriage), cohabitation agreements, and related topics.
The process of dissolving a marriage or domestic partnership begins when one spouse or partner files a Petition with the Court closest to his or her home. The party who files the Petition becomes the Petitioner, and the other party becomes the Respondent. The Petition must be personally served on the Respondent by somebody other than the Petitioner.
The upside is that you do not hire an attorney. Note that there will still be Court costs, and other expenses, even if you do not hire an attorney. Also, the Court may require you to pay some or all of your spouse's attorney's fees, depending on your case. The downside is that Family Law is relatively complicated, and you may overlook rights you have.
