Elder Law is a blend of Medicaid and estate planning. While estate planning is focused on ensuring a client's assets pass to intended beneficiaries after death, Medicaid planning is done to preserve a client's assets during life by setting a client up to qualify for government benefits (Medicaid), should the client require long-term care.
Medicaid is a government program which can be leveraged to pay for a client's homecare or nursing home needs. As a means tested government program, in order to qualify for Medicaid, a client must not have assets exceeding certain levels or excess income. This being said, however, there is almost always a way to qualify a client for Medicaid benefits.
The job of a Trusts & Estates attorney is not only to write Wills and Trusts for clients - it also includes advising clients how to be preserve assets, what we like to call Asset Protection. Tax Planning: With tax planning, the goal is to minimize taxes, thereby preserving assets. Tax planning permeates everything we do as Trusts & Estates attorneys.

As a f/t caregiver to my mom, I don’t always have the time to read, research and ask questions directly to NYS Medicaid. Mr. Haner explained what is new, what was changing and what was best for my mom’s needs. Chris came into scene when everything was upside down with my father passing. Things were difficult with my father living in fla but owning home in ny. I had spoken to 3 other lawyers and they had no idea how to help me. Chris did and it took 2 weeks. Which could have held up in court and I could have lost the buyers. Chris called me to keep me informed the entire process.
I am thankful for him, and consider him to be the utmost professional and cool person.
