If you have ever worked with a lawyer before preparing your Will or doing Estate Planning, you will, I am certain, recall how confusing and complex everything began to sound. Because we all want to have things taken care of for our children when we pass, you do what the lawyer tells you and basically go home, happy to have it all over with and forget it.
According to some surveys, over half of the adults in the United States don't have any will or revocable trust in place in the event of their death or disability. Of those individuals that do have a will or trust in place, many of them have never been reviewed or updated since they were prepared to ensure that they still comply with any changes in the law or individual circumstances.
Few things in life are more difficult than the loss of a loved one. In addition to the grief that everyone experiences, you will have to try to determine what you need to do in order to transfer their assets according to their will or trust. If they didn't have a will or trust in place or it wasn't set up in the manner set forth by law, you will need help to navigate through the legal process.
Many people feel it is not necessary to write a Will because they think it will be too costly or too difficult, or that it is unnecessary because they don't feel they have enough possessions to worry about and that they will automatically pass to their spouse or children. Sometimes people want to simply avoid thinking about their own death.
