On occasion, a will or trust will contain ambiguities regarding the distribution and division of assets, the identity and nature of beneficiaries and tax issues. If the interested parties do not contest the document outright, a construction proceeding may take place. In this instance, interested parties may ask the court for its interpretation and mediation of the ambiguous language.
There are a number of ways that a will or trust can be contested. Please see the list below for details, and contact us if you have any immediate questions or concerns. The will or trust was not properly executed - Proper execution of a will or trust requires that the will or trust be signed by the testator (the person making out the will or trust) and witnessed by at least two people, who also sign the will or trust at the end.
A fiduciary is a person that assumes a special relationship of trust, confidence and responsibility for obligations to others. Executors, administrators and trustees are examples of those who have a fiduciary responsibility to beneficiaries. Fiduciaries are charged with carrying out the asset distribution set forth in a will or trust.
The Law Office of David A. Esquibias is a firm that understands the pain and frustration of being denied the inheritance you rightfully deserve. It is important to remember that beneficiaries do have legal rights and protections. Our highly experienced legal team can help ensure that your rights are not violated during the estate administration process.
Estate or Probate Administration may be needed to implement the estate plan you have created, or as a result of your failure to create an estate plan. If you have signed a will or trust, it will be filed with the Superior Court upon your death and probated. If you have not completed an estate plan, your property will go into probate and pass to your heirs in accordance with California intestate succession law.

*WARNING-NO* Mr. David A. Esquibias!
He has not held his obligation or fiduciary legal duty to represent and act in good faith with integrity, honor, honesty and in the interests of beneficiaries as his standard of care.
My experience with him: Unfornitually he is representing my relatives in a Living Trust where I, and two others on our side of the family are beneficiaries. He is solely taken sides with a malicious, coercing and manipulating Trustee who is money & control hungry. She has hired Mr. Esquibias, who is in her image. He is shameful and disrespectful.
*NOTE: Approx. 40 some other

I concur with Mr. Stothoff....this attorney and his "client", a professional trustee from Camarillo appointed by the court took advantage of our vulnerability and lack of knowledge.
He chose to sell our family home and put us in a financial prison. His claim was, not enough money in trust to continue making mortgage payments, yet he charged over $50k in fees against the beneficiaries ( my daughters) wishes.
After the humiliation of sheriff eviction ,our house sold in August of 2019 to date we have not received any financial statements from him, his realtor, or his client, nor did we receive any

David Esquibias is a gentleman, and a scholar! His team is dedicated, and thorough, yet friendly and patient. The qualifications held by each and everyone of them exceed what is necessary to get the job done by far, and a client could not be in better hands. Their hearts extend past their pockets, and their passions for justice and their clients needs seem to drive every decision they make, no matter the challenges before them. This is the upper echelon of law firms, and the who's who of the legal world. Don't make a mistake and use anyone else if your goal is to win your case!

We had put off completing a living trust for years. My husband and I have three daughters and this had hung over our heads for years. Finally we made the call. David and his staff treated us with respect, the fees were extremely reasonable and we were given personalized care and all the time we needed to have our questions answered. It's a relief to know we have this taken care of.
