Bankruptcy is based on both federal and state laws. Under these statutes, protections are given for the debtor who is striving to resolve their debt issues and become financially secure. Under the 2005 Bankruptcy Act, all individual debtors who file for bankruptcy must undergo a credit counseling course within six months prior to starting the bankruptcy process.
Do not use your credit cards once you have made your decision to file bankruptcy. Consumer debts incurred for luxury goods and services owed to a single creditor in excess of $500.00 within 90 days of filing are presumed to be nondischargeable and may not be wiped out by a bankruptcy. With regard to repaying debts, you cannot treat your family member any better than you would an ordinary creditor.
In a Chapter 7 bankruptcy, non-exempt property is turned over to the court for sale and distribution to creditors. A person filing bankruptcy must choose between the federal and the state schedules. Our state has some of the most generous exemptions in the nation. Personal property is exempt up to $60,000 for a family and $30,000 for a single person.

I unfortunately made the decision to file for bankruptcy and a friend referred me to Mark. After my ex husband left me and my boys high and dry I couldn't keep up with the payment on my own and everything was under my name (Lesson learned) they went through the process with me and gave me time to pay before doing the work which was great and when that time came they would keep me updated and was so patient with me as I had gotten a second job in overnight and knew I would be sleeping during the day they still made sure I was doing my part as well.
