Essentially, a Pre or Post-Nuptial Agreement is very much like an insurance policy you hope you will never need. It will, however, provide peace of mind and help ensure that your pre-marital, or separate assets, will be protected. A Pre-Nuptial Agreement is an agreement signed before the date of the marriage and a Post-Nuptial Agreement is signed after the marriage.
Equitable Distribution refers to the division of marital assets in connection with a divorce proceeding. First, it must be determined what, if any, assets are subject to equitable distribution. There are certain assets that may be categorized as Separate Property as opposed to Marital Property. This is not always easy to define.
Child support is paid by the non-custodial parent to the custodial parent, generally until the minor child turns 21. There are certain factors that may result in child support ending sooner, which our firm can explain to you. In addition, the amount of child support you receive or pay, while generally determined by the guidelines set forth in legislation known as the Child Support Standard's Act, can be affected by other relevant factors.
There are remedies available to both sides if the custodial parent seeks to relocate out of New York State with the children. The laws have changed dramatically over the years, but now the court is bound by what is known as the 'best interest' of the children.

Most separation agreements or stipulations of settlement contain a 'radius' clause which mandates that the custodial parent not remove the children, on a permanent basis, within a certain number of miles from his or her present residence, without the permission of the non-custodial parent or means permission of the court. If a custodial parent is seeking to relocate, there must be some showing of good cause as to why such request was made.

I hate even rating this man 1 star, He is unprofessional, dishonest and a thief, Please stay away from this office, He lies like a rug, He refuse to complete what was paid for and is basically trying to extort more money from my family and he was paid already. We are in the process now of reporting him to the necessary authorities, This man needs to be disbarred, Luckily for us, after detecting he was so dishonest we started recording our dealings with him,

Took thousands, didn't show up a host of times for court, was late, unprepared, and rude. Failed to listen to instructions, said things he was not supposed to, worked against my case, but harassed me for money. Didn't return calls, or emails, and said negative things against me and my case. I felt like he was actually representing the opposing side and not me. THIS was absolutely the worst experience I ever had with an attorney. He hurt the case by not showing up, prior to me deciding to hire a real attorney who represents MY interests! Fired him. NO STAR would be my choice.

This review is based on experience. Jay Davis should not be a legal representative of our legal system. He makes his living on taking advantage of vulnerable people and people with money (which he takes) . He along with some of the Suffolk County Judges have made a very lucrative career on lies and deceit. If you are a golfing buddy of his that status can potentially have a negative or possibly a positive impact on your case depending on which side you are on, or who the judge is at the time. Don't fall on the wrong side. I did not have the most money at the time and saw the consequences of that

Jay Davis is a sinster attorney. He lies to the court and threatens the another party with letters behind the courts back . Jay Davis was supposed to handle my cases QDRO with both party’s paying half but he did nothing when even told by the courts. He constantly made excuses that his party had given him a check and he was waiting for the other party’s check but is was always a lie. My divorce settlement was signed in 2014 and again he told the judge he was going to take care of it but nothing. Divorce finalized in July 2015.. Nothing yet done. Then get nasty letter from him in December of
