In Florida, it is illegal to drive a vehicle while your normal faculties are impaired. Typically law enforcement officers will try to determine impairment by using one or more of three distinct methods. The first and most obvious method is the driving pattern. Factors such as speed, lane control, weaving, and tracking, are all components of an officer finding an over-all "Driving Pattern" that may indicate that the driver is impaired.
After a conviction, it is possible that a client's conviction may be overturned, or the sentence reversed or mitigated. In some cases it is possible to win a new trial. The following lists a few of the areas that can be addressed after a conviction is imposed. Rule 3.170 allows for the withdrawal of a plea at the courts discretion, upon a showing of good cause any time before the sentence is imposed.
