In 2002, Nelson Ebaugh earned his Master of Laws in Securities and Financial Regulation. Controversies surrounding securities can arise between the issuing company and its shareholders, or between broker-dealers and their customers. Mr. Ebaugh vigorously represents plaintiffs and defendants in securities litigation, including actions for misstatements or omissions, failure to register, aiding and abetting, and control person liability.
Approximately two-thirds of all securities arbitrations are between broker-dealers and their clients. Co-counsel for 31 investors in an arbitration proceeding against two limited liability companies and their managers. Claims include fraud, breach of fiduciary duty, and unjust enrichment. Obtained a $449,603 arbitration award for a limited partnership which had alleged a breach of fiduciary duty claim against its broker-dealer.
In addition to representing clients in securities litigation, arbitrations and regulatory proceedings, Nelson Ebaugh routinely represents his clients in other areas of commercial litigation.
