Before discussing the steps involved in getting a divorce in New York state, it's important to make sure it's the right decision for you. The divorce process typically takes at least a year to get through the courts. Dividing property, making decisions about child custody and child support can be very complicated and stressful, especially when there are major disagreements between you and your spouse.
Asset division is a major aspect of any divorce proceeding. In some cases, you and your ex may be able to largely agree on how to divide your property. In other cases, the division can be significant. Regardless of which type of situation you find yourself in, you likely have many questions regarding property division.
Addressing and resolving parenting concerns are a large part of our family law practice at The Arquette Law Firm, PLLC. Whether you are involved in a custody dispute, need help with child support or are attempting to establish your parental rights, our attorneys are here to help you identify your goals, explore your options and find the best path toward a solution.
The Child Support Standards Act is the relevant statute contained both in the Family Court Act for family court matters and the domestic relations law for divorce matters. It provides the formula and framework for determining the presumptive amount of child support that should be paid by the noncustodial parent to the custodial parent when the parents are no longer living together.

Tammy was extremely helpful with my custody case. Very professional, hard working, dedicated to her clients and understanding. Tammy and her staff are very helpful and work very hard to get the best outcome. Not only did I receive custody, I was granted jurisdiction change thanks to Tammy and her staff.
I’m extremely grateful.

If you are looking for an attorney who will protect your rights to the letter of the law then I recommend NOT using this firm. Especially in the realm of family law. I Had to fire the firm and initiate a new case due to a complete disregard for factual government evidence, text messages, and performing opposite actions from what was discussed during office meetings and emails.
