If you are like most New Yorkers, you have not planned for the possibility that you or a loved one may require nursing home care one day. The costs of paying for a nursing home stay in Nassau, Suffolk and. The Long Island experience is a unique one. A trust may be created during lifetime, which is known as a "lifetime" or "inter vivos" trust, or may be created by a person's last will and testament, which is known as a "testamentary trust." Trusts are frequently created to reduce and/or eliminate estate taxes, to protect assets from the claims of creditors and to qualify the grantor for long-term care (Medicaid) benefits.
In a legal sense, "probate" is the process whereby a deceased person's last will and testament, along with a probate petition and supporting documents, is submitted to the local Surrogate's Court by the proponent/petitioner asking the Surrogate's Court to declare that the last will and testament offered for probate is, in fact, both the most recent last will and testament of the deceased person and legally valid.
A living will is a document in which a person expresses his or her desire to be kept alive by way of artificial nutrition, life support, etc. after the person has sustained a substantial and irreversible loss of mental functioning. While a bit callous, many think of this document as the "pull the plug document."

When I needed a will, living will, and health care proxy, I discovered Roy List's law firm. The entire staff is extremely knowledgeable and efficient. Everything was explained to me, with all choices spelled out clearly, along with rationale as to why someone might make one choice over another given their personal circumstance.
