Services
Hilton & Bishop concentrates its practice in estate planning and in probate estate settlement and trust administration and settlement. This focus includes an emphasis on Federal and Massachusetts tax planning - estate and gift tax, generation-skipping transfer tax, and charitable planning, as well as income tax in the estate and trust area.
Many Massachusetts residents are surprised to learn that, while their estates are valued lower than the Federal estate tax exemption, currently $11,400,000, their estates could incur Massachusetts estate tax. The Massachusetts estate tax exemption is capped at $1,000,000. Even individuals whose assets will not be subject to estate tax can benefit from estate planning.
The death of a loved one is usually a time of great stress and can feel overwhelming to the surviving family members. Hilton & Bishop attorneys are here to help with the legal aspects.

Hilton & Bishop attorneys and staff help families of deceased Falmouth, Cape Cod, and greater Massachusetts residents navigate the probate courts and assists personal representatives (executors) with carrying on and completing the estate administration process efficiently - and with compassion.
Establishing a trust can be an optimal way to preserve wealth and avoid subjecting assets to the jurisdiction of the probate court after death. Hilton & Bishop attorneys work with clients to establish and administer different kinds of trusts depending on the needs and circumstances of the client, including revocable trusts (also called living trusts), irrevocable, life insurance, special needs, charitable, and dynasty trusts.
For philanthropic clients and clients whose estates can benefit from a charitable deduction, Hilton & Bishop attorneys provide advice as to how to structure charitable gifts. This includes helping clients explore their options, such as establishing a private foundation or a public charity, creating a charitable remainder trust or charitable lead trust, to name a few.
