Not only are you living through what is arguably the worst emotional trauma you have ever experienced, you are preparing to negotiate what could be the largest business transaction that you have ever fathomed.
The best interests of a child is the standard a Michigan Court will apply to the facts of any custody dispute between parents, agencies, and/or other third parties. There are two levels of custody in Michigan: legal custody and physical custody. Physical custody reflects the amount of time the child resides with each parent, and legal custody refers to decision making authority on important decisions affecting the child's welfare.
Parenting time is likewise determined by what is in the child's best interests. There is a presumption in Michigan that it is in a child's best interests to have a strong and loving relationship with both of their parents. The frequency, type, and duration of a parenting time award must be reasonably calculated to promote such a relationship.
Every child in Michigan has an inherent right to the financial support of both of their parents. Child support is a court ordered payment of money for the benefit of a child, including medical, dental, optical, and other health care related expenses; child care expenses; and educational expenses. The amount of support that must be paid is determined by application of the Michigan Child Support Guidelines.
Michigan Courts presume an equitable division of marital property, generally meaning any property accumulated by either party's contributions or efforts during their marriage. Equitable division doesn't always mean a 50/50 split, but rather just and reasonable in light of equitable principals.
