Services
My practice centers on the family. I specialize in all types of family law matters including divorce, estate planning and representing small business owners. My practice has served my clients and the community for more than thirty-five years. I began my legal career as a law clerk to Judge Jack L Ogg of the Arizona Court of Appeals, and then as a trial attorney for the United States Government.
The first step in the divorce process is a discussion with your lawyer regarding the divorce process. The court system includes a maze of procedural and substantive rules that are outside the experience of most lay people. It is important at the beginning of the case for your lawyer to take the time to explain the court process and to let you know what to expect.
The court may annul a marriage where there was a legal impediment to the marriage at the time of the ceremony. A classic example is where one party already was married at the time the parties married. Since it is illegal to be married to two people at the same time, the court may annul the second marriage.
Divorce may not be an option due to religious convictions or concerns relating to losing certain benefits. At the same time, a person may suffer harm by being financially tied to his or her spouse. If your spouse is an alcoholic, for example, you are at risk of losing everything you own if your spouse causes an accident while intoxicated.
The vast majority of cases settle before the trial is conducted. Settlement often is good for the family and may result in a substantial savings of financial resources. Settlement, however, requires both parties to be reasonable. Each party must take a realistic view of the evidence and decide to take control of their lives by deciding for themselves how to resolve the important issues that they face.

I was referred to Roger Smith by a trusted friend of the family & felt like this was a very good decision. Roger clearly knows family law well, and was very thorough and honest (which I appreciated, because I wanted to make sure I was being fair / reasonable). I felt, and still feel (even more now), that using Roger Smith was the best decision. I am confident I will get the best outcomes using Roger for my future legal needs.
