A divorce in Missouri is known as a "dissolution of marriage." A dissolution of marriage in Missouri is limited "no-fault, " meaning that a spouse only needs to show that a marriage is irretrievably broken to be granted a dissolution.
The process of a dissolution of marriage involves dividing assets and debts, possibly awarding maintenance (alimony), determining custody and parenting time for children, creating a parenting plan and calculating child support. The process for a legal separation is very similar to the process for a dissolution of marriage.

Child custody issues can be the most important, complicated, and emotional aspects of your divorce or paternity case. In Missouri, the best interests of the child is used by the Courts to determine the custody arrangement. There are two kinds of custody: legal and physical custody. Legal custody defines how major decisions for the child are made and physical custody refers to the actual right for each parent to spend time the child.
The purpose of a paternity action is to establish legal fatherhood, custody, parenting time, and child support of a child born to unwed parties. Whether a father is listed on a birth certificate or not, legal procedures are required to establish paternity and custodial rights. A paternity action may be initiated by either parent of the child.
Sometimes after your court order is entered things change and the parenting plan or child support ordered by the court is no longer in the best interests of your child or is no longer is practical. In these cases, we can request that the court modify the current order by filing a Motion to Modify. In order to modify a court order, you must be able to show that there has been a change in circumstances since the last order was entered.

She is horrendous. Absolutely unresponsive. Absolutely unprofessional and very rude. If you’re looking for someone to drag out your case! She’s your gal. If you’re expecting an answer about something and you want to wait 4-6 months for a response. She’s your gal!! Trust me, your case is not of importance to her. Apparently asking her to do the job she was paid to do is too much for her!?! Did she even pass the bar?? Is she truly an attorney?? I would question that before selecting her to represent you. She will delay and delay…it’s amazing she still has a career and clients.

My husband and I used Emily Schwappach for an adoption. She communicated regularly with us, keeping us up-to-date with our case. She always took the time to answer any questions I had. She is very straight forward and reasonably priced. We consulted with other attorneys before choosing Emily and we're very happy we went with her.

Emily was a fantastic attorney! My divorce went very well. The entire office was professional and handled my case efficiently. No one wants to go through a divorce but Emily and Alex know what they are doing and I will trust them with any future issues I may have. My ex husband’s attorney paled in comparison. If you are looking for attorneys that know clay county family law, this is the firm for you.

Wish I could give a zero star to this law firm.. charged a $2,000 retaining fee and then charged us for emailing us and the other party, phone calls to both party’s, and gas mileage to show up at court.. Emily was never available and all contact was made by her assistant.. we won our case and asked that the other party pay our lawyer fees to which Emily agreed, but never put in effect.. two months go by and she emails a bill with a total of $6,200.. knowing she did absolutely nothing... this place is poorly ran and very unprofessional... if you plan to hire Emily, expect communication to be non

Alex handled my divorce and custody case several years ago. She was very professional and worked with me on payment. The parenting plan and custody arrangement turned out very well in my favor. I have my son full time. My ex wife has every other weekend and one day a week. She took care of everything very well.
