Elder law can be defined as a holistic approach to assisting the elderly with their legal needs. Traditional estate planning focuses more on post-mortem planning and disposition of assets. While elder law attorneys are skilled in these areas, the natural extension of this practice is to assist the elderly with their pre-mortem, or lifetime needs.

The first step in formulating a plan is for an individual to disclose to their estate planning attorney the extent and nature of their assets, which includes all checking and saving accounts, IRA's, 401(k)'s or other retirement plans, life insurance policies, interests in all businesses, all real property, all valuable personal property and to disclose information about your intended beneficiaries and whether there are any special circumstances pertaining to those persons.

Medicaid is a federal program which is administered by each of the States. Therefore, there are differing laws and regulations pertaining to qualifying for each program in each state. In Florida, eligibility for Medicaid coverage is determined by the asset and income levels of both the "well-spouse (i.e., non-sick)" and the applicant spouse.

My Dad and I were so fortunate to meet Matt through a referral from our attorney. We needed guidance because my Mom was extremely sick and in Hospice Care. Matt did an amazing job guiding us through the process and making certain that all my parents assets were protected so we had no worries at all.
