Assault and Battery are two separate offenses but just one crime in South Carolina. A person can be found guilty of assault and battery if the State can prove beyond a reasonable doubt that person injured another person OR offers or attempts to injure another person with the present ability to do so.
In South Carolina it is unlawful for a person to drive a motor vehicle while under the influence of alcohol or under the influence of any other drug or a combination of other drugs or substances which cause impairment to the extent that the person's faculties to drive a motor vehicle are materially and appreciably impaired.
People can be and are often charged with drug crimes simply because they are riding in a vehicle with another person with drugs. You can be charged with drugs if the drugs are found in your house or even common areas of an apartment. You need to build your defense with a lawyer you can trust immediately.
We can't say this enough. If you are charged with murder, attempted murder, assault and battery by mob, or another violent crime it's important to get a lawyer immediately. So sad to see that for them is just about the money. I get how much will your services cost me. But what I really care about it it’s how will you help me. And I keep asking ok I get it $$$$$ but what will you do, how will you help me. But all I get from them is “if you want the info you need to sing the contract first $$$$$ or if you want to wait that is fine but It will be $100 for any other info.”
As far as I remember it wasn’t like that years ago when it was just Alex in his office answering his phone. Now his paralegals just want the money first with out helping. So sad and disappointed
